1. Acceptance of Terms

By downloading, installing, or using NutriBase ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

NutriBase is a mobile application that helps users track their nutrition, set dietary goals, and monitor their health metrics. The App integrates with Apple Health and provides tools for logging food intake, tracking macronutrients, and analyzing food quality.

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to create an account
• One person may not maintain more than one account

3.2 Account Security

• You are responsible for all activities that occur under your account
• Notify us immediately if you suspect unauthorized access to your account
• We are not liable for any loss or damage arising from unauthorized use of your account

4. Acceptable Use

4.1 You Agree To:

• Use the App in compliance with all applicable laws and regulations
• Provide accurate information when logging food and health data
• Use the App for personal, non-commercial purposes only
• Respect the intellectual property rights of the App and its content

4.2 You Agree NOT To:

• Attempt to hack, reverse engineer, or decompile the App
• Use the App to transmit malware, viruses, or harmful code
• Scrape, copy, or redistribute the food database without permission
• Create accounts using automated means or false information
• Interfere with or disrupt the App's servers or networks
• Violate any applicable laws or regulations while using the App

5. Medical Disclaimer

• The App provides nutritional information and tracking tools for informational purposes only
• The App is not intended to diagnose, treat, cure, or prevent any disease
• Nutrition calculations and recommendations are estimates and may not be accurate for everyone
• Always consult with a healthcare provider before making significant dietary changes
• If you have a medical condition, eating disorder, or are pregnant/nursing, consult your doctor before using the App
• The App's data should not be used for medical decision-making

6. Data Accuracy

6.1 Food Database

• We source nutrition data from public databases (OpenFoodFacts, USDA) and user contributions
• We strive for accuracy but cannot guarantee that all nutritional information is complete or error-free
• Nutrition values may vary based on preparation methods, brands, and serving sizes
• Users are responsible for verifying the accuracy of nutrition data for their needs

6.2 Health Metrics

• Calculations for BMI, calorie goals, and macro targets are estimates based on standard formulas
• Individual results may vary significantly based on metabolism, genetics, and other factors
• Apple Health data accuracy depends on your devices and how you use them

7. Intellectual Property

7.1 Our Rights

All rights, title, and interest in the App, including its design, code, features, and branding, are owned by NutriBase or our licensors. This includes:

• The NutriBase name, logo, and trademarks
• The App's source code and architecture
• The user interface and design elements
• Original content and documentation

7.2 Your Rights

You retain all rights to the data you create and input into the App, including:

• Food logs and meal entries
• Custom foods you create
• Notes and personal information

7.3 License Grant

We grant you a limited, non-exclusive, non-transferable license to use the App for personal purposes. This license does not include the right to:

• Resell or redistribute the App
• Create derivative works
• Remove copyright or trademark notices
• Use the App for commercial purposes without permission

8. Third-Party Services

The App integrates with third-party services including:

• Apple Health: Subject to Apple's terms and privacy policies
• OpenFoodFacts: Food database under ODbL license
• USDA FoodData Central: Public domain nutrition data

We are not responsible for the availability, accuracy, or policies of these third-party services.

9. Subscription and Payments

Note: If you implement in-app purchases or subscriptions in the future, update this section accordingly.

Currently, NutriBase is provided free of charge. If we introduce paid features in the future:

• Pricing will be clearly displayed before purchase
• Payments will be processed through the Apple App Store
• Refunds will be subject to Apple's refund policies
• We reserve the right to change pricing with reasonable notice

10. Termination

10.1 By You

• You may delete your account at any time through the App settings
• Upon deletion, your data will be permanently removed within 30 days
• You may also stop using the App at any time without notice

10.2 By Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• We detect fraudulent or abusive behavior
• Required by law or legal process
• The App is discontinued (with reasonable notice)

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, completeness, or reliability of content
• Uninterrupted or error-free operation
• Security or freedom from viruses

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUTRIBASE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from use or inability to use the App
• Damages resulting from reliance on nutritional information
• Health issues or medical complications arising from App use

Our total liability shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless NutriBase, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit or share through the App

14. Changes to Terms

• We reserve the right to modify these Terms at any time
• Material changes will be communicated through the App or via email
• Continued use of the App after changes constitutes acceptance
• If you don't agree to updated Terms, you must stop using the App

15. Governing Law

These Terms are governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.

16. Dispute Resolution

• For any disputes, we encourage you to contact us first for resolution
• We will attempt to resolve disputes informally within 30 days
• If informal resolution fails, disputes may be subject to binding arbitration or small claims court

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and NutriBase regarding the App and supersede all prior agreements and understandings.
